This Terms of Use Agreement was last updated on 02/11/08.

Note: Basic ads with photos are always free.  See the Pricing/Features link in the top navigation bar for details.  After entering your ad details and pictures you will have the choice to ad extra options for increasing your ad's visibility.  These charges are nominal and are noted near the end of the placing an ad process.

By accepting these terms user agrees that they are at least 13 years of age.

User understands that the transaction of placing an ad is a "lease" of space on the atvquadswap.com web site.  User agrees that the content of the ad is the sole responsibility of user and that atvquadswap.com in no way guarantees or warrants any perceived or expected results when placing said ad.

When you register to use the Atvquadswap.com classifieds service, you will become a registered member of the service and will select a user name and password. If you are a Registered Member, you must use that user name and password each time you log in to the Service. Registered Members are entirely responsible for any and all activities that occur under their account regardless of whether the Registered Member authorized such activity. You agree to notify Company of any unauthorized use of your account, user name or password, or any other breach of security known to you. Your right to use the Service can be revoked by Optik Star, LLC at any time for any reason or for no reason. Such right is personal to you and you agree not to resell or make any commercial use of the Service or any part thereof without the express written consent of Company.

To the fullest extent permitted by applicable law, we make no representations or warranties of any kind, express or implied, regarding the use or the results of the Site in terms of its correctness, accuracy, reliability, or otherwise. Atvquadswap.com does not and cannot review all classified advertisements available through the Service or materials posted to the Site by third persons, including Registered Members. Atvquadswap.com is not responsible for any such advertisements or materials. Atvquadswap.com reserves the right at all times to disclose any information as necessary to satisfy any law, regulation or government request, or to edit, refuse to post or to remove any information or materials, in whole or in part, that in Atvquadswap.com’s sole discretion are objectionable or in violation of this Agreement. While Company will endeavor to enforce the terms of this Agreement, we cannot warrant or represent that Registered Members will in fact adhere to this Agreement and cannot act as insurers against, or accept any liability for, their failure to do so.

User agrees that atvquadswap.com and affiliates, owners and directors will not be held liable for transactions or communications happening as a result of posting or replying to any ad on atvquadswap.com or any transactions originating on Atvquadswap.com.  Atvquadswap.com, its affiliates, directors and owners are dismissed from all responsibility and liability regarding transactions and correspondence between buyers, sellers and visitors browsing this Web site.

User also understands that atvquadswap.com does NOT provide refunds for ANY reason, to include technical or other causes in interruption of web site.  In the event of a prolonged "catastrophic" failure, atvquadswap.com may elect to extend an ad term, but will not refund the original purchase price or any pro rated amount.

User agrees that he/she will not use profanity or sexually explicit images in the content of any ad and realizes that all ad content MUST be acceptable for all audiences.  User understands that use of inappropriate content will cause the ad to be removed from the site WITHOUT refund or replacement of ad.

Users will not use the contact information obtained in the sale process of this site for any reason OTHER than contacting prospective buyers or sellers.  Users founds to be harvesting and or using email addresses for reasons other than those stated here, will be removed from the database and prevented from placing further ads.  Users and visitors found to be placing fake or fraudulent ads and correspondence will also be banned from the site with no refunds of any kind.

Company collects certain information from and about its users three ways: directly from our web server logs; information you give to us; and with cookies.

Web statistics and tracking
When you visit our web site, we may track information to administer the site and analyze its usage. Examples of information we may track include:

*Your Internet protocol address.
*Browser type or computer you use.
*Number of links you click within the site.
